Packaged Liquor Sales

 

Key points about packaged liquor sales licences

Subject to the conditions of the licence, the category authorises the licensee:

  • to sell liquor for takeaway from the licensed premises over an authorised continuous period of no more than 13 hours between 8am and 10pm
  • to sell liquor for takeaway through direct sales transactions as long as liquor is despatched and delivered in South Australia between 8am and 10pm
  • to sell or supply liquor for sampling on the licensed premises. The licence does not authorise the sale of packaged liquor from a drive-in or drive through bottle shop.

The licensed premises must only carry out business specified by the licence and must be physically separate from premises used for other commercial purposes. Goods may be sold in the same premises if they are normally associated with the sale of liquor e.g. glasses, decanters, cheeses and pates.

The licensing authority may grant an exemption from the above requirement if it believes it is in the public interest e.g. a general store in a regional location.

Physical separation of premises

Licensed premises will be considered physically separate from other commercial premises if:

  • there is a permanent barrier between them that is not transparent and at least 2.5 metres high
  • the licensed premises cannot be accessed from the other commercial premises.

A licensed premises in a shopping centre which can only be accessed from another commercial premises using a common area such as a mall or thoroughfare, complies with the separation requirements.

Who requires this type of licence

Eligible businesses for this category of licence will include bottle shops, specialist wine merchants, specialist grocers and on-line businesses.

Community Impact Assessment Requirement

A Community Impact Assessment will be required for packaged liquor Sales Licenses (except those who only sell through direct sales transactions)
